I thought I would start a Blog, and fill it up with Bloggy Bits and Trivia. Not really put much thought into it, but here is a start.

IT LIVES!!!


Yes, we live, and we won!

But we didn't win a big win.

However, the outcome is never the less, a very good one.
We are mentally exhausted after this ordeal. You cannot imagine the stress it has put on us, and not only that, but my Mum is over here as well for Christmas so, mega stress.

Our neighbours have given us the paddock across the road from where we were before, much to the dislike of the old owner from where we just came. He is a real GIT! He wanted to profit on our loss by installing a power outlet in his bottom paddock, and then charge us $50 a week m ore, for a shitload less than what we originally contracted for. Not only that, but the $6K it cost him to instal the power, he wanted us to pay half! Can you imagine it? Words fail me, when I try to describe this mans demeanour.

So, our neighbours across the way, have given us their paddock, RENT FREE! But we pay our power, which is cool, and they even installed into their electric fuse box in the garage an extra outlet for us, with a click-dial meter so we know the KW's we have used. Not only that, but if this works out, we get to house sit their home which they vacate for 4 to 6 months of the year, as they holiday over winter in warmer climates. So, a Win Win situation really, if it all works out.

We are now, right on the water, or the estuary at Ohiwa Harbour. On a low tide you can walk out off the the house truck, over the paddock, hop over the fence, and walk into the mangroves and pick Oysters off them. Mmmm. Tasty As!
From the same spot on a high tide, there are flounder around (flat fish) so a bit of floundering, or is it philandering is plentiful here!.
We are very glad that we did not have to move away from this community, as 99% of all the people here are really nice. We got Karl again to get us down the hill, and we videoed that as well, so we shall update the YouTube ids etc as soon as we get around to it.
That was all done for a Bottle of Appletons Rum. So, a bottle up, a bottle down, and a Box of Red for Ozzy, Karl's local sidekick who was safety and backup tractor on the day(s).

Amy and myself would also like to give a warm thank to all of You who supported us over the past mental weeks of hell. It is very humbling to see such generosity in a time of crap shit. Thanks for the reality check, as during dark times of crap shit, to see the lights of You shining bright was what we needed.

For the 1st time in ages I have slept without disturbance. The feeling of knowing that we are safe and this whole shite is over was a great relief.
The Tribunal was a disappointment, as C21 were thrown the book, but were let off lightly. However the Adjudicator, did mention if we wanted to follow through with some of our claims, she was not enacted to judge, but there were forums available who would give it a looking into. I understood that as, go get em, but not here, we don't have the clout.
They were ordered to give us our rent back, for misrepresentation, fraudulent contracting and offering a substandard property for rent.
2 days later, and we have not had a peep from C21, and the Bank says zilch.
So, I pop down to the courts, and ask the clerk what his interpretation of IMMEDIATE was, as this was what was written on the order for our payment or return of our 15 weeks of rent.
The Clerk said, go to collections over there and talk with Willy, our 10 foot tall, 6 foot wide bailiff. He was happy to enforce the order and called C21 to say he was popping over to collect. Jenny, the losing C21 Agent, hung up on him screaming the likes of not being that appreciative to threats. So, he called again, and suggested she be reminded that this was no threat, but the LAW. Hee hee.
I zoo want ed to be there when he collected. But he had advised me, that Jenny the Agent for C21 had a trespass order written out to me, and would serve it as soon as I stepped foot in the building. What a biatch. So, no video of that I am afraid, but the bailiff collected, and now C21 are trying to Embezzle the owner out of $1200 saying it was his responsibility. But the order was written out to them and not him. C21 have withheld 2 weeks of our rent, 2 weeks of the neighbours rent, and want to collect another 30 days rent so as to get their money back. WHICH IS ILLEGAL.
But I don't care. I am out of there. I spoke with the owner, and suggested after he waste a load of precious time chasing them around, we do a 2 pronged attack and law suit on C21 in the new year. I think he has finally accepted that C21 were at fault here, and not just him. Still, I am beginning to sway towards, what is done is done, and lets move on. Screw it, there are bigger fish to fry.

So, I shall slowly get back into it. There is heaps to do here, and we are expanding our web development team as well. So all you TikiWiki fans out there, if you want to get stuck in, get in touch with Kent!

Well, today was the day.


We went to Tribunal, and got royally shafted. But we won. But we were screwed, but we won.

We won, but we didn't.


It's like this. We were given compensation because of misrepresentation of the property offered.
We were given compensation for lack of quiet enjoyment of the property because the neighbour leases the land we are on, and has horse treks on a regular basis, that pass our home directly. Nothing like taking a dump on the long drop, and at the same time say good morning to a Korean Horse Trekking Party.

We also won compensation for the condition of the property, it being rat infested, uninhabitable, and no compliance as well as any certification or anything. Shouldn't have been made available to the public.
So, sounds good eh?

Well, this is what we got.

  • All our rent back, plus we are ordered off the property by noon Sunday, this week.


This sums up to $1200.00 in total, which is what we have spent in rent whilst we were here. Trouble is, its going to cost me $1500 just to get a tow truck to tow my truck somewhere. The somewhere bit we haven't figured yet, as we have nowhere to go that can supply us power and water.

So, basically we have been chucked out onto the street 2 weeks before Christmas.

Chucked out on the road

  • in a house truck with no breaks
  • and no NZ legal anything.
  • So, as soon as its on then road, I am illegal,
  • and could have it impounded.
  • Fucking Great!


Can't go to a camp site, because we have animals, and not forgetting Amy has a full-time job as I also do. Which we won't be able to do on a fucking camping site.

The only 2 places we have been offered, both have no power or water.

  • The cheapest tanks for water I can find are on TradeMe, and will cost more than what we have.
  • Power to any of the properties, we have been quoted from $13.5K to $18K just to hook up power.
  • The cheapest off grid system we found was a small gene set, solar and batteries, for around $6K. But we would really have to be careful on power consumption. It can be expanded upon, but minimal is that.

So, probably as of Sunday 12th of December, I shall be signing off till further notice.


As of sunday, I don't really know what will happen. We have been told the Tenancy Tribunal Orders are final, and there is no way to appeal. I would appeal, even if I was the winner today. I certainly don't feel like one.

We slammed C21 today in Court. Their Claims were dismissed against us, and they were made to look stupid and bad. I really thought justice was going to do the right thing here, but no.

There must be a law here that lets people become homeless. It was ordered today that I do just that.

Sure, I'll accept that Order..... and put myself and my partner into harms way.

So... what if we disobey the order, and stay?

The owner has already said he will kill me, and trash my truck.

A risk worth taking? I dunno. Amy doesn't think so.

If we stay, we get no peace, and will no doubt spend the entire time here in fear. Nice.

If we go, we will crash the house truck at the bottom of the 1st hill.

If I had 10K, I would buy a gene set and solar and battery thing, buy a 5000 litre water tank for just under a K, which leaves just about enough for the tow truck people, and setting up satellite internet and hopefully a bottle of rum for Xmas. That would be nice, to actually sit down and enjoy myself, in peace.

I am sure there are a lot of people saying, send them a bill. Bills follow orders.
Or, Claim the Land, or what not.

This is our livelihood we are playing with, and not a car fine, or unpaid bill.

We lose our house truck, we lose everything. I can't afford to fuck this up, and the Police here have already called me a few weeks ago, and let me know they were keen to sort me out. Thugs you know the Opotiki Cops are.

Pure thick as shit thugs.

So, what to do?

I have basically this week to figure it out and then its aster la vista baby.

So, we moved to paradise, and eventually got our house truck, El Freedom up the hill.
Many of you may have read the original post in the NZ section, but that went tits up, and the thread was lost.
Anyhow, for these of you who have no idea, it is as follows.

We moved from a 4 bedroom lovely house in the lakes district into a house truck, parked on a hill, and not a lot else.
Yes. we had the dream home, a Lockwood cabin, by the lake near Rotorua, and neighbours that were like surrogate parents. They were also our landlords, and we lived there for 6 years.
All was well, in the land of Pete, but we were paying quite high rents, I mean not really high, but high enough, to add up to a lot of nothing.
So my partner and I decided to make a move, and start maybe a Freeman Valley thing. That was interesting, and we had a lot of keen people at 1st. but then it died off, and we looked at other options.
We looked at leasing a large piece of land with some people, but that also did a dive in the downwards way, so we decided that the only people we can rely on, are ourselves.
We looked for a small piece of land, and eventually found where we are advertised as a residential property to rent.
It was a shack, but had space for our truck and room for what we needed.
So we moved and 40 days later we have been given notice to move out, in 42 days.
In other words, we are required to leave by the 19th Nov 2010.
So we looked into this, and found out a few things from some great posters here. Also, we dug up some info on the owner, and after a little this and that we were in communication direct. We emailed a few times, and then we were threatened by email by the owner which raised the bar somewhat.
Now, as this is all going on, we are still unpacking, and now we need to pack and move somewhere else.
Hmm, there is nothing out there for $80 a week.
Sound cheap eh? Well it is. But have a look for something out there similar or even slightly similar?
We have looked high and low, and spoken with dozens of farmers. There sure is space, but not all have power and water.
These 2 little things are extremely important to us, as we run many sites, and both work. Well, I emulate the working thing, but my partner is the real grafter.
We need internet and phone. The phone can be mobile and Skype, but power is a biggun.
Now there has been loads of discussion of energy power converter generator thingys and there sure are a lot of em out there.
I too have researched, and I am as broke as a church mouse. So, if it costs shitloads, I can't afford it.
You see, we spent all our savings and such getting here. The house truck was moolah, and towing it half way across the bay of plenty was also not cheap. All the logistics of moving, etc. It isn't easy. Especially since we made the move from 320 a week to 80 a week, to reduce massive debt, and get ahead.
Our home, our truck, we paid a deposit for, and are paying the rest off as rent to buy. The previous owners have moved down south and no longer need here, so when we made them the offer, they accepted, so the money we are saving in rent, is paying off El Freedom.
If we were moving from a 320 a week, and needed to move to a 320 a week property, well, easy pees. There are hundreds out there. But at this price, I can get a car park in the city, or a camping spot.
I am not a gypsy, and a camping ground will not do. My cats will hate it for a start.

So, the owner of this land is Canadian. I thought may have been a good thing, but after a few emails, we was horridly rude, and obnoxious, threatened me and my home, and well, was a prick.
I thought that may have been a good thing. I mean, he emailed me his intent to smash my home, and more. He was pissed off, and was intimidating.
I hadn't even started excerting any rights, and he was right in there, being an asshole.
Our advice was to trespass him. I was even told that by a few people. But get this. He turns up last week, and pops round. Is an asshole and slimes around a bit. I recorded the event on audio.
He then buggers off.
Calls me on Sunday, leaves a message saying he will be back tuesday. I call back and say, no thanks. We are busy this week with tribunal and mediation. (Thursday) So please leave it till after that. He would not allow this.
I reminded him that he needed my consent, and that within reason, waiting a few more days till after thursday was quite a reasonable offer.
I then received a phone call from SNR SGT Dipstick from a local Police station.(I can't name anyone or places yet until its in the open properly) And he went on to tell me that the owner would be around on wednesday. I recorded this too.
I said that was nice of you to tell me SNR SGT. But I don't consent to him coming round.
At this point the SS butted in and told me I had no right to do that.
I tried to get a word in, but he spoke over me like a robot.
I waited for my turn, and then proceeded to explain that I was the legal occupant, and the owner had made threats of intimidation and criminal assault, and blah blah, and he butts in again.
You do not have any rights. You are a tenant, and he is the owner. He can do as he pleases.
I said no he can't, he may well be the owner, but where does it say he can make threats and act outside of the law? (please see attaching document)
Also, where in the trespass act does it say I cannot trespass? Who can?
ONLY THE OCCUPANT... Me.
And I can trespass anyone I like if they breach the peace.
SS then hung up on me, and then called me back. Very odd.
He then went to explain, that if I tried to stop the owner from entering the property, I would be arrested. I asked under what charge, and he bellowed over me, shouting that I cannot do that.
I said that he would be breaching the peace, and if the Police turned up, and allowed him to enter, they too would be in breach of the peace, and be criminal nuisance.
He then told me to come down and make a formal complaint.
I did, and he ran off. I walked into the Police Station,. and as soon as he said, oh yeah, this morning on the phone, he ran away.
I was not recoding audio, but I hit record, rang the bell and waited.
I waited 9 minutes, before a younger chap, SGT Bonkers began to tell me the law.
I said I would like to make a complaint, and press charges against Mr. ......
Now listen here Mr. What was your name again? You can't come in here and tell me how to do my job.
I said, and butted in, EXCUSE ME!
Here is my affidavit. Here is when and where it was submitted.
Here is the evidence.
Here are 9 pages of legislation you are required to know before you go any frothier.
And...

He basically replied, I am too busy for this shit. Come back tomorrow at 8am.
It was 3 pm at the time.
What?
He then said, if I didn't leave now, he would trespass me.
I tried not to smile.
I looked at him, and said that he was under oath, and should remember that.
I walked away, rather perturbed.

What gets me is this.
Our contract here is a fraud, as unfortunately the land we are on is leased in a private agreement, meaning C21 fraudulently rented this out on the sly.
The owner is a dick, and hates house trucks.
Tenancy Tribunal think we are on a winner in that C21 and the Landlord have acted outside of the law.
A lawyer also said the same.

The Cops are pissing on us and don't even have the curtsey to call it rain, as is C21 and the Landlord, and in the meantime, this nutcase, with the backing of the local cops will come here on Wednesday, and breach the peace.

Wow, another year almost. Blimey.

Well, in the past 11 months, it has been quite hectic. The site here has morphed into an even better site than before, our member count has increased hugely, and I have taken a roller-coaster of a mad ride to hell and back.

Yes, currently, I reside in Hades. I moved from heaven on my own accord, and took a swift trip down the tube to HELL.

We were living in paradise, the garden of eden. It was truly fabulous, and everything was OK. Except, we were paying rent to a landlord, who by the way we love very much, and keeping them in superannuating leaving ourselves treading the mill, and getting nowhere.

So, we made a calculated move, and got rightly stitched up, by Century21 Whakatane, and the owner of the land we moved onto, Mr. D. Head, for now.

A year has nearly whizzed passed and in some respects it has really whizzed along.
But in other areas, it has almost moved at Glacial speed.
For example, a year a go, no WFS, and whizz along a year and we are here.
Or, my iMac died a year ago and Apple screwed me, real slow, and then my MacBook started to die a few months ago, and Apple Screwed me, so I purchased a refurbished iMac from the Apple Sore, and Apple Screwed me with a DOA iMac, so I sent that back and Apple Screwed me as they have failed to send out a replacement, and overtime I call and ask WTF? Apple Screw me, with "Err, we'll call you back, and or, I can't help, I am in USA, or SINGAPORE, or INDIA, and AUSSIE has the details."
Hmm. Yes, some things have whizzed along, and others, well seem to linger like a bad fart.
