"Wirral Council is taking Roger Hayes to Birkenhead county court for non-payment of council tax.
Mr Hayes, chairman of The British Constitution Group, claims the council tax is illegal and imposed without his consent.
His stand has won support from all over the country, and demonstrators travelled miles to protest outside the court building.
But, as judge Michael Peake tried to get the case under way, Mr Hayes repeatedly demanded whether he was "on oath of office".
Judge Peake insisted it was a "properly constituted court", and said if Mr Hayes had a complaint it was an issue he could take up later.
But Mr Hayes again asked if he was on oath of office and when he did not get an answer he was happy with, said: "Sir, I am obliged to arrest you for contempt of court and treason."
Two supporters of Mr Hayes then attempted to make the arrest but were stopped by police."

A police officer has been injured outside of Waterstones in Piccadilly. He is currently being attended to by an ambulance and health staff said his situation is stable. I saw him inside the ambulance with a neck brace and ice packs on his legs. It looks pretty serious.
Night has fallen, Hyde Park is clearing out, and we're starting to see more of the ugly clashes that have come to typify big public order demonstrations in London.
If the story today was very much a huge turnout of people opposed to government cuts, what we have seen so far tonight should not overshadow that.
Earlier nurses, teachers, students, doctors and pensioners all felt that they had been involved in something significant: a moment when their opposition to the government's spending cuts was given a powerful voice. Most would have remained oblivious to the fact that a dozen shop windows in the West End (randomly chosen, it seems, but there was a preference for banks and multinationals) were smashed and covered in paint.
Television pictures from tonight will change that. There appear to be thousands stuck in the West End, either unable to exit kettles or determined to confront police. It is hard for us to give a comprehensive picture, as police appear to have contained protesters in several "mini kettles" around the West End, but there are repeated ongoing confrontations. Bottles, bricks, sticks and fencing are being thrown. Police are striking back, and repeatedly surging at the demonstrators.
On Jermyn Street, repeated clashes ended in protesters turning fences, planks of wood and upturned bins into burning barricades, causing a serious fire that fire-fighters were called to extinguish. There are around 1,000 protesters in Trafalgar Square. It seems more peaceful here, with one woman trying to teach an Arabic chant to the crowd in the ongoing (and largely unsuccessful) attempt to "turn Trafalgar into Tahrir". This will probably continue, in a downward spiral, for a few more hours.

Protesters break into bank, clash with cops as London march turns violent.
The police were outnumbered by over 1000:1 and as the day grew older, and the darkness started to fall, so did the demeanour of the people protesting.
Unfortunately for a Bank who deals in Fiat Currency, and Loans out Credit in the good old fashioned 'screw you for every penny" attitude these Banksters have was on the 'other' end as we see protestors destroying a Bank and smashing up the insides.
What would prompt such an outburst? Well, may we recommend you watch a documentary on Google called 'Money as Debt'. You may want to burn your own local bank down after watching that.
However, other incidents also have occurred with a shop on Piccadilly Circus also being set aflame.

Paul Lewis has called in with a report of a fire in Piccadilly that appears to be getting out of control.
The fire is on Jermyn Street next to Piccadilly. It began about 15mins ago when clashes broke out between the police cordon and protesters. The protesters ripped up scaffolding and planks of wood, filled a waste bin and set it alight. That fire has now spread with flames reaching 11ft high, and from where I'm standing it looks like it is getting out of control. There's a thick plume of black smoke rising into the sky. I'm about 30ft away and can feel the heat from where I'm standing. Riot police have cleared the immediate vicinity but the whole area around Piccadilly is becoming something of a magnet for people looking to cause disruption. The situation is now getting dangerous.
Police now say 75 arrests have been made in London today.

London is experiencing one of the largest demonstrations in recent years topping all in the last 10 years.
With an expected outcome from between 100,000 to 250,000 people turning up, it is clear now that this number has already exceeded 400,000 from a source at the Guardian UK.

More and more people are flooding into London with reports from all over the City as demonstrators decent towards Hyde Park and Trafalgar Square.
The Police are on the look out for any unrest and bad behaviour, but as they are outnumbered many times over, it's their behaviour that will be on the line today.

Protesters in good spirits as hundreds of thousands march in London against the coalition's programme of spending cuts
Matthew Taylor says thousands of people are still joining the march, with the total number estimated at around 400,000.
"I am now on a footbridge overlooking the Embankment and people have been streaming underneath us for about an hour. People are queuing as far back as I a can see and tens of thousands more are still arriving from side streets. Organisers are suggesting there could be as many as 400,000 here today. That is impossible to verify at this stage. But it is clear that this is a very big demo."
Peter Keats, 54, from Lowestoft, Suffolk, who works for Jobcentre Plus, said:
"We're toasting the success as so many people have turned out. The press were saying 100,000 people but I think we have far exceeded that. I'm hoping for half a million. I'm hoping the government will start to listen with this many out.
"Personally, I think it's wrong the way we are hitting the poor. I'm not so much worried about myself but the customers I deal with are vulnerable and I'm worried about them and I'm worried about the kids of this country."
Alan Dowling, 40, who works for the UK Border Agency in Sheffield, said:
"The other day the immigration minister was on TV saying we need to do more. How are we going to do more enforcement when we are cutting enforcement officers?"
